Mohamed Fauzi is escorted to the Sessions Court to face charges over an alleged RM5 million criminal breach of trust case.

KUALA LUMPUR : A senior officer of the Malaysian Armed Forces (ATM), Mohamed Fauzi, was charged at the Sessions Court today with criminal breach of trust involving RM5 million.

The accused, who held a key position in the organisation’s financial management division, is alleged to have misappropriated funds entrusted to him for personal use between 2022 and 2024.

According to the charge sheet, Mohamed Fauzi is accused of transferring substantial amounts of money into several personal and third-party bank accounts without proper authorisation, in violation of established financial procedures and the trust placed in him.

The charge was framed under Section 409 of the Penal Code, which carries a penalty of up to 20 years’ imprisonment, whipping, and a fine upon conviction.

Mohamed Fauzi pleaded not guilty after the charge was read out and claimed trial. The court allowed bail at RM150,000 with two sureties and ordered him to surrender his passport to the court.

The prosecution requested strict bail conditions, citing the large sum involved and the accused’s senior position within a national security institution.

The court fixed March 18 for case mention and the submission of relevant documents.

The case has drawn public attention due to the senior rank of the accused and the substantial amount allegedly involved, raising concerns over financial oversight and integrity within the defence sector.
